I. IntroductionWelcome to Tails & Talons Creations!
I create custom fursuits, art, and related products, all made by hand with care,
attention to detail, and high-quality materials.These Terms of Service (“TOS”)
outline what you can expect when commissioning me, and what I expect from you as a client.By placing an order, paying a deposit, or otherwise engaging in a commission with
me, you confirm that you have read, understood, and agreed to these Terms. This ensures a smooth, transparent process for both of us and helps prevent misunderstandings.
These Terms apply to all commissions, whether physical (e.g., fursuits, fursuit parts) or digital (e.g., concept art, reference sheets). Please review them carefully

DefinitionsFor the purposes of these Terms of Service (“TOS”), the following definitions apply:1. Client: The individual or entity commissioning work from Tails & Talons Creations.2. Commission: Any custom work requested by the Client, whether physical or digital.3. Product: The completed item delivered to the Client as part of a commission.4. TOS: This Terms of Service document.5. Deposit: A non-refundable portion of payment made in advance to secure a commission slot and cover initial costs.6. Payment Plan: A mutually agreed schedule for making payments over a specified period.7. Rush Order: A Commission requested with a faster-than-standard turnaround, which may incur additional fees.III. Age RequirementIII.I – General Minimum Age● Clients must be 18 years of age or older to commission any product or
service from me, including but not limited to fursuits, fursuit
parts, props, digital artwork, traditional artwork, and laminated handmade chibi drawings.● Clients under 18 must provide written and direct parental or legal guardian approval before work begins.● Proof of age and parental consent must be provided upon request.III.II – 18+ / NSFW Content● Clients must be 18 years of age or older to commission any 18+ or NSFW content.● Proof of age will be required and verified prior to acceptance of the
commission.● Any falsification of age will result in immediate termination of the
commission, forfeiture of any payments made, and refusal of future service.● 18+ / NSFW content will only be accepted at my sole discretion and must comply with the Prohibited Content guidelines in Section IV .IV. Prohibited ContentIV.I – General PolicyI reserve the right to refuse or cancel any commission at any time if the requested content violates these guidelines.The following categories of
content are strictly prohibited.
This applies to all commission types — including, but not limited to, physical fursuits, costume parts, props, traditional artwork, digital artwork, sketches, badges, chibi drawings, and laminated items.No request will be fulfilled that requires the Artist to create, depict, imitate, or suggest any of the following:IV.II – Explicit and SexualContent Restrictions1. Sexually explicit content involving minors (real or fictional), including but not limited to depictions in the style of “loli,” “shota,” or any portrayal of underage characters in sexual or romantic contexts, regardless of whether they are presented as fictional, stylized, or “safe.”2. Fetish content of any kind, including but not limited to:○ Foot fetishism or paw fetishism
○ Inflation, weight gain, or feederism
○ Bondage, BDSM, or sexual restraint
○ Pregnancy fetishism
○ Transformation fetishism of a sexual nature
○ Any other sexual paraphilia, regardless of context3. Vore in all forms, including soft vore, hard vore, implied vore, or fetishistic
predation.4. NSFW content involving kemono, toony western, or toony paw styles,
whether digital or physical.IV.III – Violence and Harm1. Any depiction of real individuals (living or deceased) in scenes of imminent
danger, harm, torture, dismemberment, or death.2. Any recreation, parody, or reinterpretation of real-world tragedies,
including but not limited to:○ Terrorist attacks
Natural disasters with significant loss of life Historical genocides or mass killings○ School shootings or other mass violence events3. Depictions intended to promote, trivialize, or eroticize physical injury,
death, or bodily harm.IV.IV – Prohibited Style & Genre Requests (Physical Commissions)1. Kemono-style suits (characterized by oversized eyes, exaggerated facial
expressions, and a distinctly Japanese cartoon aesthetic).2. Toony western suits (highly exaggerated cartoon styles inspired by Western
animation, including over-simplified paw designs).3. Toony paw styles (overly stylized or comedic paw designs inconsistent with
the Artist’s offered styles).IV.V – Catch-All ClauseAny commission request that:1. Violates applicable local, national, or international laws;
2. Promotes hatred, bigotry, or discrimination against a protected class;3. Contains sexual or fetish content not explicitly listed above;
4. Depicts or encourages illegal activity;…will be refused at my sole discretion.IV.VI – Enforcement● Any violation of these prohibitions will result in immediate cancellation of the commission, forfeiture of any payments made, and permanent refusal of future service.● The Artist’s decision on prohibited content is final and non-negotiable.V. Communication Policy
V.I – Contact Methods● I’m happy to communicate through the platform you originally contacted
me on (e.g., email, Discord, Instagram, Twitter/X, Facebook, etc.).● If at any point I feel a project would benefit from moving to a more
organized platform (e.g., email for large file sharing), I may suggest
switching.V.II – Response Time● I try to respond to messages within three (3) business days.● During busy periods, conventions, or emergencies, it may take longer — but I will always try to keep you updated if there are delays.V.III – Progress Updates● I generally provide updates at important stages:1. Initial design or sketch approval
2. Materials confirmation
3. Mid-progress updates
4. Final approval before shipping or delivery● If you want more frequent updates, please let me know — I’m happy to
keep you in the loop.V.IV – Client Responsibility● Please reply to approval requests promptly so I can keep your project
moving.● If I don’t hear back within seven (7) days, I may place the commission on
hold until I receive a response.● Extended silence without warning may result in cancellation (see Section VII – Refunds & Cancellations).VII – Refunds & Cancellations).V.V – Written Confirmation● Any major decisions, approvals, or changes to your commission must be confirmed in writing.● “In writing” simply means a message I can save and refer back to — this can
be a text message, an email, a Discord DM, an Instagram message, or similar.● Verbal conversations (including phone calls and voice chats) don’t count
unless they’re followed up with a written message confirming what was agreed.● This is for both your benefit and mine — it keeps a clear record of what we agreed on, avoids misunderstandings, and gives us both something to reference if questions come up later.VI. Payment TermsVI.I – Accepted Payment Methods● I currently accept payments via PayPal and Ko-fi for secure transactions.● Alternative payment methods may be considered on a case-by-case basis
and must be agreed upon in advance.● All payments will be converted to GBP (British Pounds Sterling) upon
receipt.VI.II – Pricing● All listed prices are non-negotiable and are based on the current market
value for my products and services.● Discounts may be offered at my sole discretion, including for returning
clients or close friends/family.● Any discount or special rate will be agreed upon in private written
conversation and is not guaranteed for future commissions.VI.III – Deposits● A non-refundable deposit is required to secure a commission slot in my queue.● The deposit amount will be determined based on the total price, quantity of items, and complexity of the order.● Deposits are applied toward the final balance of the commission.VI.IV – Payment Plans● Payment plans are available for commissions over £500 GBP (British
Pounds Sterling) and may extend up to five (5) months.● The number of installments and payment schedule will be determined on a
case-by-case basis and finalized in writing before work begins.● Payment plan terms are binding once agreed upon. Failure to make
payments on time will result in late fees (see VI.V).VI.V – Late Payments● If a scheduled payment is late, a £50 late fee will be added every three (3) days until the overdue amount is paid, up to a maximum of £200 in late fees (15 days late).● If payment has not been received within twenty-one (21) days of the due date, I reserve the right to:1. Cancel the commission;2. Destroy, alter, or resell the commissioned product (if applicable);3. Retain any amounts already paid as compensation for time and
materials.VI.VI – Final Balance● The full balance of the commission must be paid before the completed product is shipped or digital files are delivered.VII. Refunds & Cancellations
VII.I – General Policy● Due to the custom and handmade nature of my work, all sales are final once the project has been completed, approved by the Client, and shipped/delivered.● I do not offer refunds for buyer’s remorse or changes of mind after the item has been approved and dispatched.VII.II – Cancellations by the Client● If a Client cancels before work begins, only the non-refundable deposit will
be retained.● If cancellation occurs after work has started, the Client remains responsible for the cost of all materials purchased and any labour completed up to that point.● If the project is near or at completion, no refund will be given.VII.III – Approval Before Shipping● Photos of the completed commission will be provided for Client approval prior to shipping.● Once the Client has confirmed satisfaction with the final product and paid
the remaining balance, the order will be shipped.● Approval constitutes acceptance, and no refund will be given for
dissatisfaction after delivery unless covered under VII.IV.VII.IV – Damage in Transit● I am not responsible for damages caused by postal or courier services once the item leaves my possession.● If damage occurs in transit, I will work with the Client to determine possible solutions, which may include but are not limited to:1. Providing repair instructions or guidance;2. Accepting the item for repair (shipping costs both ways to be covered by the Client);3. Assisting the Client in filing a claim with the postal/courier service.● Full refunds for transit damage will not be offered unless agreed upon in
writing at my sole discretion.VII.V – Chargebacks and Disputes● Filing a chargeback without first attempting to resolve the issue directly with me is considered a breach of contract.● In cases of chargebacks, all rights to the commissioned work will be
revoked, and I reserve the right to publicly resell, alter, or repurpose the
work.● The Client will be responsible for any fees, costs, or damages incurred as a result of the dispute.VII.VI – No Large-Scale Refund Capacity● As a small, independent business, I am not financially able to offer
large-scale refunds once a project is completed. This policy ensures I can
continue to operate and deliver quality work to all clients.VII.VII – Cancellations by the Artist● In rare cases where I must cancel a commission for personal or unforeseen
reasons, a partial or full refund (minus any completed work or purchased materials) will be provided.VIII. Proofs, Watermarks, and Intellectual Property ProtectionVIII.I – Watermarked Proofs● For digital and traditional artwork, I will provide low-resolution and/or
watermarked proof images for Client review and approval before final
delivery.● Watermarks will only be removed once the final payment has been received
in full.VIII.II – Ownership Before Payment● All artwork remains the sole property of PillowOwlArts until the agreed
payment is completed in full.● Proof images, sketches, and previews may not be used, altered, distributed,traced, or reproduced in any way until ownership is officially transferred
upon payment.VIII.III – Prohibited Actions● Removing or attempting to remove a watermark from any proof image
before final payment is strictly prohibited.● Using AI tools, editing software, or any other method to erase watermarks,
alter, or complete the unfinished work without payment will be treated as copyright infringement and theft of services.VIII.IV – Consequences of Misuse● Any unauthorized use, reproduction, or distribution of watermarked or
unpaid artwork will result in:1. Immediate cancellation of the commission without refund;
2. A permanent ban from future services;3. Possible legal action to recover damages and enforce copyright rights.VIII.V – Intellectual Property Creation Boundaries● I will not create, replicate, or recreate copyrighted characters, designs, or
media that are owned by another party without clear evidence of permission from the copyright holder.● I will not directly copy or trace any artwork belonging to another artist.● I will not replicate or imitate another artist’s distinct style (e.g., Vivziepop) for commissions.● For fursuits, I will not replicate an existing character design (including
another person’s original character/OC) without documented proof of
permission from the owner.● I may create inspired characters or designs that draw from general themes,
aesthetics, or genres, provided they are original and not direct copies of any copyrighted or trademarked work.● For digital and traditional art, I may create artwork depicting copyrighted
characters in appropriate, permitted contexts if they fall under fair use (e.g., fan art for personal, non-commercial use), but the client will not receive ownership of the underlying IP.VIII.VI – Reference Images for Approval● Traditional artworks will be photographed or scanned with a watermark for
approval before shipment.● Digital artworks will be shown at a reduced size/resolution with a
watermark until paid in full.IX. Intellectual Property & Usage RightsIX.I – Client Rights After Payment● Once full payment has been received, the Client has full ownership of the physical or digital item.● The Client may freely use, gift, sell, modify, or resell the purchased item
without restriction.● This includes resale of fursuits, digital art, traditional art, and other physical
or digital media purchased from me.IX.II – Artist Rights After Payment● Even after payment, I retain the copyright to the original work and may use images of the commissioned work for self-promotion, portfolio display,
social media posts, or advertising.● Copyright transfer (full ownership of all reproduction and authorship rights) is not included unless specifically agreed upon in writing and may involve an additional fee.IX.III – Ongoing Restrictions● Clients may not claim they created the original work unless copyright
transfer has been explicitly agreed upon in writing.● Clients may not reproduce the work for commercial merchandise (e.g.,mass-printed shirts, posters, or products) without my written permission.● Clients may not submit my work into AI training datasets or use it in any form of machine learning without my explicit written consent.IX.IV – Credit and Attribution● Credit is appreciated but not required for physical items.● For digital artwork posted online, I request that credit be given to
PillowOwlArts where possible (e.g., tagging my handle or linking to my
IX.V – Limitations on Third-Party Intellectual Property● If a commission incorporates elements inspired by or referencing
copyrighted material owned by a third party, the Client understands that they do not acquire ownership of the underlying intellectual property
● Ownership rights granted under this Agreement apply only to my original creative contribution (e.g., unique suit construction, original illustrations, or
custom designs) and not to any pre-existing characters, franchises, or trademarks referenced within the work.● The Client is solely responsible for ensuring that their intended use of such
commissioned works complies with the rights of the original IP holder.X. Shipping & DeliveryX.I – Physical Goods (Fursuits, Fursuit Parts, and Other Handmade Items)● All physical orders are securely packaged to protect against damage in transit.● Shipping is carried out using trusted courier services such as Royal Mail,
Parcel Force, or equivalent, with tracking provided whenever possible.● Once the item has been handed over to the postal/courier service,
responsibility for delays, damage, or loss passes to the Client. I am not
responsible for mishandling, delays, or damage caused by postal or courier
services.● Insurance may be available upon request at the Client’s expense; if not
requested, shipping is provided at the Client’s own risk.● International Clients are responsible for all customs duties, import taxes,
and fees charged by their country.● I will not understate the value of goods on customs forms.X.II – Damaged or Lost Items● If a package arrives damaged, the Client should document the damage
immediately with photographs and contact the postal/courier service to file a claim.● I will work with the Client to assist in claims but cannot guarantee
reimbursement or replacement.● Depending on the situation, I may offer repairs or partial compensation at my discretion.● For additional policies regarding damage during transit and potential
remedies, please refer to Section VII.IV – Damage in Transit.X.III – Digital Delivery (Digital Art, Reference Sheets, and Other Digital Products)● Completed digital work will be delivered via email, Ko-fi message, or
another agreed-upon secure method.● Files will be sent in high resolution without watermarks once full payment is received.● I will retain the original files for at least thirty (30) days after delivery. After that time, I am not responsible for storing or resending files if they are lost by the Client.● Download links or file access (if used) will remain active for fourteen (14) days unless otherwise agreed. It is the Client’s responsibility to download and back up their files promptly.XI. Turnaround Times & DeadlinesXI.I – Estimated Timeframes● Turnaround times vary depending on the nature of the commission, my
current workload, and supply availability.● Approximate completion estimates will be provided at the time of
acceptance. These are estimates only and not guaranteed deadlines unless explicitly agreed upon in writing.XI.II – Start Date● Work will not begin until the deposit (or full payment, if required) has been received and all necessary information, references, and measurements have been provided.● Delays in providing information or approving designs will result in a later start date and may push the final completion date back accordingly.XI.III – Client-Related Delays● Failure to respond to approval requests or provide required details within seven (7) days may result in the commission being placed on hold.● Commissions placed on hold for more than thirty (30) days without
communication from the Client may be cancelled, with any applicable
refund subject to Section VII – Refunds & Cancellations.XI.IV – Missed Deadlines● If a fixed deadline is agreed upon in writing and I miss it for reasons within my control, I may offer a partial refund, discount, or other mutually agreed resolution.● Deadlines missed due to events outside my control (see Section XV –
Force Majeure) will be addressed on a case-by-case basis.XI.V – Rush Orders● Rush orders may be accepted at my discretion for an additional fee,
depending on my current workload and the complexity of the project.XII. Client ResponsibilitiesXII.I – Accurate Information● The Client is responsible for providing accurate and complete information for their commission.● For physical goods, this includes correct measurements, character
references, and any other details needed for construction.● For digital/traditional art, this includes clear descriptions, mood boards, or examples that accurately reflect the desired style, pose, or scene.XII.II – Timely Communication● The Client must respond to messages, approval requests, and questions within seven(7) days to avoid delays.● Extended lack of communication may result in the commission being
paused or cancelled (see Section VII – Refunds & Cancellations).XII.III – Reference Material● Reference images may be provided for style, setting, pose, or inspiration,
regardless of whether they are copyrighted, provided the Client
understands that the final work will be an artist’s interpretation of those
references.● I will not directly trace, copy, or replicate copyrighted works or other
artists’ original characters without written permission from the copyright holder.● References should be used to convey ideas, not to demand exact
duplication.XII.IV – Approval of Work-in-Progress● For projects that require client approval, the Client must confirm or request revisions within the stated time window.● Failure to approve in time may lead to the project being delayed or
completed without further changes.XII.V – Responsibility for Post Delivery Use● Once a commission has been delivered, the Client is responsible for how it is used, displayed, resold, or stored (see Section IX – Intellectual Property & Usage Rights for details).● The Client is solely responsible for complying with any third-party
intellectual property restrictions when using the commissioned work.XIII. Artist ResponsibilitiesXIII.I – Quality Standards● I will complete all commissions to a professional standard, using materials and techniques appropriate to the product type.● For physical goods, I will ensure all seams, attachments, and components are secure and functional at the time of shipping.● For digital/traditional art, I will ensure the work matches the agreed style, theme, and general concept approved by the Client.XIII.II – Communication● I will maintain clear and respectful communication with the Client
throughout the commission process.● Updates will be provided at key stages, including concept approval, major build stages, and before final completion, unless otherwise agreed in writing.● Messages will generally be responded to within seventy-two(72) hours, excluding weekends and public holidays.XIII.III – Deadlines● I will make all reasonable efforts to complete commissions within the
estimated timeframe provided at the time of booking.● If unforeseen delays occur, I will inform the Client as soon as possible and provide an updated estimate.XIII.IV – Care of Client-Supplied Materials● Any materials or references provided by the Client will be handled with care and used only for the purpose of completing the commission.● Any original items (e.g., physical props sent by the Client) will be returned only if agreed upon in advance and the Client covers return shipping costs.XIII.V – Professional Conduct● I will not knowingly engage in any project that violates applicable laws or infringes on the intellectual property rights of others.● I will act in good faith to ensure all work meets the agreed terms and
conditions outlined in this document.XIV. Revisions & ModificationsXIV.I – Ensuring Satisfaction During the Process● My aim is for you to be happy with your commission, so I provide
opportunities for feedback at key stages before the work is finalized.● For physical goods, this may include adjustments to colors, markings, or
accessories before final assembly.● For digital/traditional art, this may include tweaks to poses, expressions,
backgrounds, or other small details before the final render.XIV.II – Included Revisions● Every commission includes up to two(2) rounds of reasonable revisions during the work-in-progress stage at no extra cost.● These revisions must be requested within the feedback windows provided at each stage.XIV.III – Additional Changes● Revisions beyond the included two(2) rounds can be provided for an
additional fee, agreed upon in writing before work continues.XIV.IV – No Changes After Completion● Once a commission has been marked complete and the final files or product have been delivered, no further changes will be made.● This ensures the integrity of the work and allows me to give the same level of attention to new projects.XIV.V – Major Design Changes● Requests for major changes — such as complete character redesigns, changing a fursuit’s species, or significantly altering a scene — after work has begun will be treated as a new commission and billed accordingly.XV. Force MajeureXV.I – Definition● A “Force Majeure Event” means any event or circumstance beyond my reasonable control that prevents, delays, or makes it impractical to complete your commission as agreed.● This includes, but is not limited to: natural disasters, fire, flood, severe
weather, war, civil unrest, labor disputes, acts of terrorism, major illness or injury, government restrictions, pandemics, or significant supply chain
disruptions.XV.II – Impact on Deadlines● If a Force Majeure Event occurs, deadlines will be extended for the duration of the disruption.● I will make all reasonable efforts to communicate any delays promptly and provide an updated timeline when possible.XV.III – Cancellation in Extreme
Circumstances● If it becomes impossible to complete the commission due to a Force Majeure Event, either party may cancel the agreement without penalty.● In such cases, I will return any portion of payment that has not already been
used to cover materials, labor, or other project-specific costs.XV.IV – Client Cooperation● The Client agrees to work in good faith to adjust timelines or project scope if a Force Majeure Event significantly impacts the original agreement.XVI. Privacy & Data ProtectionXVI.I – Information Collected● In the course of providing commission services, I may collect personal information such as your name, email address, shipping address, and payment details.● Only the information necessary to complete your commission and conduct business will be collected.XVI.II – How Your Information is Used● Your information will be used solely for:○ Processing and completing your commission○ Communicating about your order○ Shipping physical goods to you○ Maintaining accurate business records for legal and tax purposesXVI.III – Storage & Security● All personal information is stored securely and will not be shared with third parties except when necessary to complete your order (e.g., providing your shipping address to a courier).● Payment processing is handled via secure third-party platforms such as
PayPal or Ko-fi; I do not store full payment card information.XVI.IV – Data Retention● Order and communication records may be retained for up to seven(7) years to comply with legal, tax, and business requirements.● After this period, any personal data that is no longer required will be
deleted or securely destroyed.XVI.V – Client Rights● You have the right to request a copy of the personal information I hold about you, request corrections to it, or request its deletion where legally permissible.● Requests can be made via the same communication method used to place your order or by email.XVI.VI – Exceptions● I may disclose personal information if required to do so by law, in response to legal proceedings, or to protect my rights, safety, or property.XVII. Legal Limitations & Governing LawXVII.I – Limitation of Liability● I am not liable for any indirect, incidental, special, or consequential
damages that may arise from the purchase, possession, or use of my
products or services. This includes, but is not limited to:○ Injuries caused by misuse or improper handling of physical items
such as fursuits, costume parts, props, or accessories.○ Loss or damage caused by shipping carriers, couriers, or postal
services, including delays, theft, or destruction once the item has left
my possession.○ Allergic reactions or sensitivities to materials, fabrics, adhesives, or
other substances used in the creation of a product, provided that
material information has been disclosed to the Client prior to
purchase.○ Losses or damages to third parties caused by the Client’s use of the
commissioned item or artwork.● My maximum total liability to the Client will never exceed the total amount paid for the specific commission in question.● I cannot be held responsible for financial loss, emotional distress, or
reputational harm resulting from a commission, provided I have acted in
accordance with these Terms of Service.XVII.II – Governing Law & Jurisdiction● These Terms of Service, and any disputes or claims arising from them or their subject matter, are governed by and interpreted in accordance with the laws of England and Wales.● Both the Client and I agree that any legal proceedings will take place
exclusively in the courts of England and Wales.● The Client acknowledges that commissioning me from outside the United Kingdom does not exempt them from the application of UK law to the transaction.● The Client further agrees that any claim must be brought in a UK court, and that legal costs, travel costs, or inconvenience arising from the choice of jurisdiction are the responsibility of the party bringing the claim.XVII.III – Severability● If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining
provisions will remain in full force and effect.● An invalid clause will be interpreted, where possible, in a way that reflects
its original intent without rendering the rest of the agreement void.XVII.IV – Entire Agreement● These Terms of Service, together with any written amendments or
variations agreed upon by both parties, represent the entire agreement between the Client and myself.● No other statements, promises, or representations — whether made
verbally, in writing, or via email, social media, instant messaging, or any other communication method — will be legally binding unless confirmed in writing by both parties.● Any waiver of a right or obligation under these Terms must also be agreed upon in writing to be valid.XVIII. Agreement to TermsBy commissioning me, the Client acknowledges that they have read, understood, and agreed to these Terms of Service in full.● These Terms apply to all commissions, whether the agreement was made
through email, social media, messaging apps, or other platforms.● Proceeding with payment — in full or in part — will be taken as acceptance of these Terms.● Clients are encouraged to save or print a copy of these Terms for their
